Conditions of Hire for Cruisers

1. .BOOKINGS:  A CRAFT IS NOT  CONSIDERED BOOKED UNTIL THE COMPLETED & SIGNED BOOKING FORM  AND A DEPOSIT  OF 25% OF THE TOTAL HIRE CHARGE HAS REACHED OUR OFFICE.  ONLY THEN WILL BOOKING BE CONFIRMED IN WRITING AND  BY INVOICE. 

2. BALANCE OF ACCOUNT: THE HIRER IS RESPONSIBLE FOR THE WHOLE OF THE HIRE CHARGE AND THE BALANCE MUST BE PAID ON OR BEFORE THE DATE OF EMBARKATION.  IF THE HIRER FINDS HE / SHE UNABLE TO TAKE OVER THE CRAFT , HE / SHE MUST NOTIFY THE COMPANY IMMEDIATELY AND EVERY EFFORT WILL BE MADE TO RE-LET THE CRAFT.  IF SUCCESSFUL THE COMPANY WILL REFUND THE BOOKING DEPOSIT LESS 15%.  IF THE CRAFT IS NOT RE-LET , THE FULL BALANCE OF THE HIRE CHARGE REMAINS PAYABLE. 

4. CANCELLATION INSURANCE:  WE RECOMMEND THAT CANCELLATION INSURANCE IS ARRANGED AND PAID FOR AT THE TIME OF BOOKING.  THE COST OF THIS IS 3% OF THE TOTAL CRUISER HIRE CHARGE.  THIS MEANS THAT IN THE EVENT OF CANCELLATION THE FULL BALANCE IS NO LONGER DUE TO BE PAID TO THE COMPANY. SIMPLY REMIT THIS PAYMENT TOGETHER WITH YOUR BOOKING DEPOSIT.

3. EMBARKATION & ACCOUNTS:  EMBARKATION TIME IS BETWEEN 16:00 & 20:00 ON THE COMMENCING DAY OF HIRE PERIOD.  ON ARRIVAL , THE HIRER MUST  PAY THE BALANCE OF THE HIRE CHARGE TOGETHER WITH THE REFUNDABLE SECURITY / DAMAGE DEPOSIT.  ALL PAYMENTS MADE ON DAY OF EMBARKATION MUST BE BY CASH OR CREDIT / DEBIT CARD ONLY.  IF CLIENT WISHES TO PAY BALANCE OF ACCOUNT BY CHEQUE , HE / SHE MUST POST PAYMENT AT LEAST ONE WEEK IN ADVANCE OF THE START DATE. 

4. NOVICE HIRERS :  NOVICE CREWS WILL NORMALLY BE EXPECTED TO ACCEPT AN ADDITIONAL PERIOD OF FREE INSTRUCTION PRIOR TO THE CRAFT BEING HANDED OVER  TO THEM. 

5. RETURN OF CRAFT:  CRAFT MUST BE RETURNED & VACATED IN A CLEAN CONDITION NOT LATER THAN 09:00 HRS ON THE FINAL DAY OF HIRE.  FAILURE TO COMPLY  WITH THIS CONDITION WILL RESULT IN AN EXTRA CHARGE OF £50 PER HOUR LATE.  AFTER CHECKING IN , IF THE CRAFT IS FOUND TO BE IN A CLEAN AND UNDAMAGED CONDITION ,  THE SERCURITY / DAMAGE DEPOSIT WILL BE REFUNDED.  CREWS WHO RETURN CRAFT IN AN UNCLEAN CONDITION CAN EXPECT TO PAY BETWEEN £100 & £150 FROM THEIR SERCURITY / DAMAGE DEPOSIT. 

6. SERVICE & REPAIRS:  EACH STAFF MEMBER USES EXTREME CARE TO ENSURE CRAFT ARE IN GOOD ORDER WHEN HANDED OVER, BUT THE COMPANY CANNOT BE HELD RESPONSIBLE FOR ANY DELAY IN THE HIRERS PROGRAMME DUE TO BREAKDOWN OR THE COMPLETION OF NECESSARY MAINTENANCE. SHOULD REPAIR BE NECESSARY DURING A PERIOD OF HIRE, THE HIRER MUST NOTIFY THE COMPANY AND REPAIR WILL BE EFFECTED AT NO COST TO THE HIRER UNLESS THE CAUSE OF THE BREAKDOWN IS DUE TO THE NEGLIGENCE OF THE HIRER OR HIS/HER CREW.

7. INSURANCE:  EACH CRAFT HAS FULL COMPREHENSIVE INSURANCE COVER. THIRD PARTY RISKS ARE COVERED UP TO £2000,000. THERE IS AN EXCESS ON EVERY CLAIM AGAINST THE CRAFT. THIS EXCESS (£400) IS CARRIED BY THE HIRER BY WAY OF THE REFUNDBLE SECURITY/DAMAGE DEPOSIT. THE COMPANY ACCEPTS NO LIABILITY FOR DEATH OR INJURY TO THE HIRER OR ANY MEMBER OF HIS/HER CREW OR FOR LOSS/DAMAGE TO THEIR PROPERTY, HOWEVER CAUSED.

8.  PASSENGERS:  PASSANGERS OTHER THAN THOSE NOTIFIED ON THE BOOKING FORM MUST NOT BE CARRIED ON OUR CRAFT AT ANY TIME WITHOUT THE PERMISSION OF THE COMPANY. HIRERS FOUND TO BE IN BREACH OF THIS CONDITION WILL HAVE THEIR CHARTER TERMINATED FORTHWITH.

9.  ACCIDENTS:  IT IS THE HIRERS RESPONSIBILITY FOR THE SAFE NAVIGATION OF THE CRAFT ON CHARTER. IN THE EVENT OF AN ACCIDENT, THE HIRER MUST NOTIFY THE COMPANY IMMEDIATELY WITH FULL DETAILS OF THE EVENT AND THE NAMES & ADDRESSES OF ANY WITNESSES.

10.  DELAYS:  THE COMPANY CANNOT BE HELD RESPONSIBLE FOR ANY DELAY TO THE HIRERS PROGRAMME DUE TO NAVIGATIONAL WORKS  ETC, OUTSIDE THE CONTROL OF THE COMPANY.

11.  AVAILABILITY OF CRAFT:  IF DUE TO UNFORSEEN CIRCUMSTANCES OUTSIDE THE CONTROL OF THE COMPANY THE CRAFT BOOKED IS NOT AVAILABLE, EVERY EFFORT WILL BE  MADE TO PROVIDE A SIMILAR CRAFT. IF THIS IS IMPOSSIBLE, THE BOOKING DEPOSIT WILL BE REFUNDED IN FULL AND THE HIRER  WILL HAVE NO CLAIM AGAINST THE COMPANY.

12.  PETS:  PRIOR PERMISSION MUST BE OBTAINED AT THE BOOKING STAGE BEFORE ANY PETS ARE PERMITTED ABOARD ANY OF OUR CRAFT.  IT SHOULD BE NOTED THAT WHERE PERMISSION IS GRANTED,  THERE WILL INEVITABLY BE A CLEANING SURCHARGE OF £100 - £150 WHEN THE CRAFT IS RETURNED.

13.  FUEL:  CRAFT ARE HANDED OVER TO HIRERS WITH FULL FUEL TANKS.  ON RETURN FROM HIRE, CRAFT HAVE THE FUEL TANKS REPLENISHED AND THE HIRER IS CHARGED FOR THE AMOUNT OF FUEL USED AT CURRENT RATES.

14.  HIRERS PROPERTY:  THE COMPANY OR THE COMPANY INSURERS ACCEPTS NO LIABILITY FOR LOSS/DAMAGE TO HIRERS PROPERTY.

15.  TOWING:  UNDER NO CIRCUMSTANCES MUST OUR HIRERS EITHER GIVE OR ACCEPT A TOW  TO/FROM ANOTHER CRAFT WITHOUT PRIOR PERMISSION.  PLEASE NOTE, THIS RULE IS ABSOLUTELY  RIGID AS PAST EXPERIENCE HAS SHOWN THAT SUCH ACTIONS CAN LEAD TO FATALITIES.  IF YOU EXPERIENCE A BREAKDOWN OR RUN AGROUND WHILST TRAVELLING,  STOP THE ENGINE IMMEDIATELY,  LOWER THE ANCHOR,  THEN TELEPHONE OUR OFFICE ON  + 44 (0) 28 66387034.

16.  NAVIGATIONAL RESTRICTIONS:  NAVIGATION IS PERMISSABLE ONLY DURING DAYLIGHT HOURS.  THE COMPANY RESERVES THE RIGHT TO RESTRICT CRAFT FROM ANY PART OF THE WATERWAY SHOULD ABNORMAL WATER LEVELS/WEATHER CONDITIONS OR OTHER NAVIGATIONAL PROBLEMS DEEM THIS NECESSARY.  ADDITIONALLY,  THE COMPANY RESERVES THE RIGHT TO REFUSE TO HAND OVER A CRAFT TO ANY HIRER WHO THE COMPANY DEEMS IS UNFIT TO TAKE CHARGE.  HIRERS WHO ARE SUSPECTED TO BE UNDER THE INFLUENCE OF ALCHOHOL/DRUGS WILL NOT BE PERMITTED TO TAKE CHARGE OF ANY OF OUR CRAFT.  IN SO DOING, WE WILL ACCEPT EVIDENCE FROM VARIOUS AGENCIES (EG;  POLICE SERVICE,  WATERWAY WARDENS, MARINA MANAGERS ETC). WHEN MAKING SUCH DECISIONS.  IT MUST BE UNDERSTOOD THAT  SUCH RESTRICTIONS ARE IN THE INTERESTS OF ALL LAKE USERS SAFETY AND WELLBEING, OUR OWN HIRERS INCLUDED.

17.  BROCHURES & CHARTS:  EVERY EFFORT IS MADE TO ENSURE ACCURACY OF PRINTED MATTER. THE COMPANY CANNOT BE HELD RESPONSIBLE FOR ANY INACCURACIES THAT MAY EXIST DUE TO CHANGES IN CIRCUMSTANCES ETC. PLANS AND MAPS ETC MAY NOT NECESSARILY BE TO SCALE.
